Uncontested Divorce

An uncontested divorce is one where both parties agree to all matters of the separation, including how the marital property and debts will be divided, who will have legal and physical rights to the children, and any issues of financial support. Uncontested divorces are the simplest and the fastest to obtain because there is no drawn out process of negotiation or a full-blown court trial.

 

When spouses cannot agree on the best way to exit the marriage, the divorce is contested and all matters will be settled through a legal process. While an uncontested divorce may seem impossible at the beginning of a separation, many couples would ultimately prefer it if they could find a way to work together with their soon-to-be ex-spouse because it is faster, less expensive, and less stressful.
