Physical Custody
Physical custody refers to which parents have the right for their children to live with them. When both parents have the right for their children to live with them, it’s called joint physical custody. Joint physical custody is commonly practiced where the children spend one week at their mom’s house and the next week at their dad’s house. Parents who share physical custody can work together to agree on an arrangement that works for everyone’s schedule.
When the children live with one parent full time, that parent is considered to have sole physical custody and goes to the other parent’s house for visitation. Physical custody is separate from legal custody, so one parent may have the right to live with their children full time, but still be required to work with their co-parent to make decisions on behalf of their children.
